New York Roofscapes, Inc. ASLA ("New York Roofscapes," "we," "our," or "us") is committed to protecting the privacy of visitors to our website located at nyroofscapes.com (the "Site") and individuals who contact us through the Site. This Privacy Policy explains what personal information we collect, how we use it, with whom we share it, and the choices available to you.

By accessing or using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please discontinue use of the Site immediately.

We collect information in two ways: information you provide to us voluntarily, and information collected automatically when you visit the Site.

Information You Provide Voluntarily. When you submit a consultation request, download a manual or guide, subscribe to Field Notes, or contact us through any form on the Site, you may provide us with your name, email address, telephone number, property address, and a description of your project or inquiry. You are not required to provide this information, but certain features of the Site — including gated content downloads and consultation scheduling — are unavailable without it.

Information Collected Automatically. When you visit the Site, our servers and third-party analytics providers automatically collect certain technical information, including your IP address, browser type and version, operating system, referring URL, pages viewed, time spent on pages, and the date and time of your visit. This information is collected through cookies, web beacons, and similar tracking technologies.

Cookies and Tracking Technologies. We use first-party and third-party cookies to operate the Site, remember your preferences, analyze traffic patterns, and serve relevant advertising. You may configure your browser to refuse all cookies or to alert you when cookies are being sent; however, some features of the Site may not function properly without cookies. How We Use Your Information

We use the information we collect for the following purposes:

  • To respond to consultation requests, inquiries, and messages you send us.
  • To provide access to gated content, including manuals, case studies, and Field Notes articles, after you have completed a lead-capture form.
  • To send you project updates, newsletters, and promotional communications, where you have opted in to receive them. You may opt out at any time by clicking the "unsubscribe" link in any email we send.
  • To analyze Site usage and improve the content, design, and functionality of the Site.
  • To serve targeted advertising through Google Ads, Meta (Facebook/Instagram), and similar platforms, based on your browsing behavior and interests.
  • To comply with applicable legal obligations and to enforce our Terms of Use.
  • To protect the security and integrity of the Site and our business operations.

We do not sell your personal information to third parties. We do not use your personal information to make automated decisions that produce legal or similarly significant effects.

Sharing of Information

We share your personal information only in the limited circumstances described below.

Service Providers. We engage trusted third-party service providers to operate the Site and deliver services on our behalf, including website hosting, email delivery, analytics, and customer relationship management. These providers are contractually obligated to use your information only as directed by us and in accordance with this Privacy Policy.

Analytics and Advertising Partners. We share data with Google Analytics, Google Ads, and Meta Pixel to analyze Site traffic and to serve targeted advertising. These partners may use cookies and similar technologies to collect information about your activity on our Site and other websites. You may opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on and out of Meta advertising through your Meta account settings.

Legal Requirements. We may disclose your information if required to do so by law or in response to a valid subpoena, court order, or government request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of New York Roofscapes, our clients, or the public.

Business Transfers. In the event of a merger, acquisition, or sale of all or substantially all of our assets, your personal information may be transferred to the acquiring entity, subject to the same privacy protections described in this policy.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Consultation inquiry records are retained for a minimum of three years for business continuity purposes. Analytics data is retained in accordance with the default retention settings of our analytics providers (typically 26 months for Google Analytics).

You may request deletion of your personal information at any time by contacting us at the address below. We will honor deletion requests within 30 days, subject to any legal obligations that require us to retain certain records.

Security

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures include HTTPS encryption for all data transmitted between your browser and our servers, access controls limiting who within our organization can access personal data, and regular review of our security practices.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you as required by applicable law.

GDPR & International Visitors

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) or equivalent legislation may apply to our processing of your personal information. In that case, the following additional rights and disclosures apply.

Legal Basis for Processing. We process your personal information on the following legal bases: (a) your consent, where you have provided it; (b) the performance of a contract or pre-contractual steps at your request (e.g., responding to a consultation inquiry); (c) our legitimate interests in operating and improving the Site and our business; and (d) compliance with a legal obligation.

Your Rights. Subject to applicable law, you have the right to: access the personal information we hold about you; request correction of inaccurate data; request erasure of your data; object to or restrict our processing of your data; and request portability of your data in a structured, machine-readable format. Data Transfers. The Site is operated from the United States. If you are located outside the United States, your personal information will be transferred to and processed in the United States, which may not provide the same level of data protection as your home country. By using the Site, you consent to this transfer.

Supervisory Authority. If you are located in the EEA, you have the right to lodge a complaint with your local data protection supervisory authority if you believe our processing of your personal information violates applicable law.

Right to Delete. You have the right to request that we delete the personal information we have collected about you, subject to certain exceptions.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

Do Not Sell. We do not sell personal information as defined under the CCPA. We do share data with advertising partners as described in Section 04, which may constitute "sharing" under the CCPA. You may opt out of this sharing by contacting us.

Children's Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected personal information from a child under 13, we will promptly delete it.
